Purpose.  This Privacy Policy is here to better serve those who are concerned with how their information is used online. The information on this page describes what type of information we collect, what it’s used for, and the measures we take to protect it.

Effect.  By using risemediation.com and/or viewing, downloading, requesting, or otherwise engaging with R.I.S.E. Mediation email, information, mediation services, promotional or other material, submission or scheduling forms, social media, and/or any other material or services we offer via this website or direct email at any time, you voluntarily and implicitly agree that you have read (or had the opportunity to read and chose not to), understood, and consented to this Privacy Policy as stated.

Overview.  We do not share or sell consumer personal information, and no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. We do not engage in affiliate marketing, nor have we nor do we share data with any affiliates. We do not advertise on behalf of third parties, nor share your data with third parties unless required for our website and its visitor requests to function in their intended manner, or required in the context of legal compliance, safety, and/or the protection of site visitors, clients, or potential clients. Any such categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Capacity:  To use this site, you must be at least 18 years old and be able to consent to this Privacy Policy. “Agreement”, singularly, or “Agreements”, collectively, means this Privacy Policy, our Terms & Conditions, Cookie Policy, and Disclaimer.

“Company”, “we”, “our”, or “us” means Anne MacIver LLC DBA R.I.S.E. Mediation and risemediation.com (collectively, “R.I.S.E.”).

“Content” means any and all written, visual, video, audio, downloadable and other information contained on or accessed via the Site and/or included in or offered or provided by us via the Site, email, mobile app, link, podcast, portal, streaming or other media, social media or marketing outreach (paid or otherwise), or other communication or access medium at any time, including but not limited to (i) graphics, designs, layouts, blog posts, and email lists, (ii) all other intellectual and/or creative output, including but not limited to our name and branding, whether or not registered with a state or federal trademark or copyright office, and whether or not displaying a trademark™ or copyright© symbol, (iii) any and all emails received from R.I.S.E. or Anne MacIver, and (iv) material used, purchased, viewed, consumed, and/or downloaded via any medium referenced or contemplated herein expressly including but not limited to our Services (as defined below) as well as promotional material.

“Personal Information” means information that can be used on its own or in conjunction with other information to identify, contact, or locate a person or to identify an individual in context. For example, Personal Information includes, among other things, your name, address, email address, telephone number, credit card information, and site behavior.

“Service(s)” is a subset of Content (as defined above) and means any service and/or benefit(s) described as offered or provided by us for informational purposes, consideration, use, future purchase, viewing, download and/or other consumption via the Site, email, mobile app, link, podcast, portal, streaming or other media, social media or marketing outreach (paid or otherwise), or other communication or access medium, including but not limited to newsletters, emails, social media posts and uploads, promotional material, blog posts, information, courses, video tutorials, Zoom or Q&A sessions (live or recorded, video, audio, or transcribed), streaming and video (live, recorded, or transcribed), events and event invites, mediation services, checklists, documents, ebooks, forms, guides, planners, templates, workbooks, worksheets, and any other services or related materials we may offer or provide at any time for use, purchase, viewing, download and/or other consumption via the Site, email, mobile app, link, podcast, portal, streaming or other media, social media or marketing outreach (paid or otherwise), or other communication or access medium at any time.

“Site” means risemediation.com and any and all of its associated pages and posts, tabs, landing pages, forms, features, sub-pages, functionality, and elements.

“You” or “your” means the user, customer, or viewer of the Site.

Incorporation by Reference

The R.I.S.E. Cookie Policy is hereby linked and incorporated by reference into this Privacy Policy and thus forms a part of this Privacy Policy.

Further, this Privacy Policy is itself incorporated by reference into the Site’s Terms & Conditions and thus forms a part of those Terms & Conditions. Every visitor to this Site is subject to and deemed to agree to the Terms & Conditions, as stated and unmodified.

Who We Are

We are an Illinois family mediation resource, and we provide information, education, and a means of pursuing Illinois mediation in a family, relationship, or divorce context. Our website address is https://risemediation.com. This page explains what data we collect from you, how we use it, and why.

Company Statement

The Site and the Content are owned by Anne MacIver LLC DBA R.I.S.E. Mediation, a registered Illinois limited liability company. We are committed to protecting your Personal Information. We will only collect or use your Personal Information in accordance with this Privacy Policy.

Consent

By viewing, using, or purchasing/downloading on or from the Site or its Content, you acknowledge that R.I.S.E., its members, its staff, and its independent contractors may access your Personal Information, within the parameters, terms, and conditions set forth in this Privacy Policy.

When do we collect Personal Information?

We collect Personal Information from you when you submit a form via our website, scheduler, or client portal (the scheduler and portal offered via integration with HoneyBook), contact us via the website or the contact information provided on thereon, respond to a survey or communication from us, and/or browse or interact with the Site. You are not required to provide Personal Information to browse the Site.

What kind of Personal Information do we collect?

Personal Information you provide.  When using the Site, and in filling out forms and/or user fields or contacting us, you may be asked to enter your name, email address, mailing address, payment or credit card information, or other Personal Information. We use this Information to deliver the services purchased or information requested, to improve the performance and applicability of the Site and the Content, and to provide you with the best content we can, which may include educational content, newsletters, promotions, and special offers. (For further information, see “Comments, Submissions & Uploads,” below.) At this time, we do not maintain or populate any mass email list using Personal Information, such as for a newsletter or marketing communication.

Personal Information otherwise collected.  The Company may use data collection technology (such as Google Analytics) to collect information related to your use of the Site which, generally speaking, includes information about your geographic location and Site behavior. The data collection company(-ies) also provides us with information about what type of device or software you use, your IP address (with location information), and whether you view the Site on mobile, tablet, or desktop. We collect this information for statistical purposes only and to improve the viewer experience.

User Submissions

Data collected.  When a visitor fills out a form on the Site (for example, via our Consultation booking form), we collect the data shown/submitted in the input fields, as well as the visitor’s IP address and browser user agent string to help spam detection.

How do we use your Personal Information?

Email lists (if you’re outside the European Union and United Kingdom).  If you purchase or sign up to receive any Service(s) from us, you may automatically be added to an email list(s) to receive free email messages from us. At this time, we do not send any mass emails, and can only envision doing so under exceptional scenarios such as a business change or event prompting the advisability of a group alert to potential or existing clients.

Email lists if you are in the European Union or United Kingdom.  If you purchase or sign up to receive any Service(s) from us, you will only be added to our email list to receive free email messages from us if you affirmatively consent to receive such messages.

User experience improvement; fulfillment of our mission and values.  If you use our Site or the Content, including any Services, we may use the Personal Information we collect from you in the following additional ways:

  • To allow us to deliver the type of service our clients expect from R.I.S.E.
  • To improve our Site in order to better serve you
  • To quickly process a request or transaction initiated by you
  • To send the occasional email regarding the Site and/or R.I.S.E. Mediation

What if the Personal Information we have about you is incorrect or you want to update it?

If the Personal Information we have collected about you is incorrect or incomplete in any way, or you would like to update what we have, please email us. We will make the appropriate corrections when notified, as long as the corrections requested to be made are not incorrect or fraudulent in any way.

Who else receives your Personal Information?

Shared by or transmitted through us.  We do not sell, trade, transfer, or otherwise allow or facilitate the access of your Personal Information to outside (third) parties, whether for marketing or advertising purposes or otherwise, except as follows:

  • Law enforcement, government entity(-ies), court(s), and/or other third party(-ies) as required and/or allowed (for a compelling purpose such as legal compliance, personal or client protection, or safety) by applicable law, to comply with or facilitate an investigation, process, or inquiry
  • Third-party service providers that provide tools, platforms, or services necessary to maintain this Site and/or related to the management and operations of our Company—such software platforms may receive and/or process your data as part of their service to us and can include website performance assessment (such as Google Analytics), payment processing (such as Square or Stripe), and client scheduler or project management tools (such as Honeybook or Google Workspace)
  • Automated spam detection and prevention service(s) and/or other security technology whose function is to protect our Site
  • Subsidiaries, contractors, subcontractors, assigns, affiliates, and/or successors in interest of R.I.S.E. as necessary to carry out our business functions, so long as such parties agree to keep the Information confidential—this may include website hosting partners and others contracted to assist us in our business, such as third-party tech support engaged to repair or improve our Site periodically (during which they have the same Site and Information access as any Site administrator)

Disclaimer for non-personally identifiable visitor information.  If you choose to make your Personal Information available directly to or for viewing by third parties through our Site or our Services, R.I.S.E. is not responsible for any unauthorized use by that third party.

How do we protect your Personal Information?

Security and malware protection.  We aim to make your visit to our Site as safe as possible and thus take many precautions to protect the data that is shared with us. In addition to the measures mentioned elsewhere in the Agreements, we use a managed hosting service that provides several security layers. Backed by the Cloudflare Enterprise web access firewall, the site is secured with enterprise-grade security before any attempts are made to reach the host server. In the unlikely event such attempts were to reach the server, Imunify360—a comprehensive, next-generation malware scanner and total security installation—runs on each node, adding another layer of defense. Your Personal Information is only accessible by a limited number of persons who have special access rights to these secured systems and are required to keep the Personal Information confidential.

Enterprise-grade encryption.  All sensitive credit card or payment information you supply is encrypted via Secure Socket Layer (SSL) technology. All transactions are processed through a gateway provider. We will never transmit your credit card information by email.

How long we retain your data

We may retain your data until we dissolve our business or you request us to delete it, whichever comes first.

Do we use “cookies” or social media pixels?

Cookies.  We, and third parties as described herein and in our Cookie Policy, use cookies and collect information from the computer, mobile phone, and/or other device(s) you use to access the Site, read our emails, or view our Content and/or advertisements. Information and detail on these cookies and our use of them is contained in the Cookie Policy, which is incorporated by reference in its entirety into this Privacy Policy (meaning, you are subject to and assumed to have read our Cookie Policy). Note: In the unlikely event of any conflict between the cookie information on this page and the information contained in our specific Cookie Policy, the information in the Cookie Policy shall supersede and be deemed to replace the conflicting information in this Privacy Policy.

Pixels.  The Company may explore the use of social media pixels (Facebook pixels) to track visitors to the Site for the purpose of tailoring messaging or advertisements towards those visitors on various social media platforms (including but not limited to Facebook, Instagram, Twitter, Reddit, or LinkedIn), and we therefore reserve the right to use pixels in accordance with the terms of those social media platforms.

What rights you have over your data

If you have uploaded information to our Site, you can request to receive an exported file of the data we hold about you, including any Personal Information you have provided to us. You can also request that we erase any Personal Information we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes. Please contact us to make any such request.

Third-Party Links & Embedded Content

This Site may, from time to time, knowingly or unknowingly, include embedded third-party content and/or links to third-party websites (e.g., videos, images, articles, blogs, third-party products or services).

Separate policies for outside websites.  Third-party websites may or may not have separate and independent privacy and/or cookie policies. We have no responsibility or liability for the content and activities of these linked sites and/or their privacy policies, cookie policies, terms and conditions, or lack thereof.

Embedded content behavior determined by source site.  Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website directly. Such other websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Google Ads & Analytics

Analytics.  We reserve the right to use Google Analytics. 

Ads.  We may, from time to time, engage the services of Google Ads, so that people in need can find us online. You can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt out by visiting the Network Advertising Initiative Opt-Out page or by using the Google Analytics Opt-Out Browser add-on.

California Online Privacy Protection Act (“CalOPPA”)

CalOPPA stretches beyond California to require any person or company that operates websites collecting Personal Information from California viewers/consumers to post a conspicuous privacy policy on its website stating exactly what information is collected and identifying those individuals or companies with whom it is being shared. 

Pursuant to CalOPPA, we agree to the following:

  • Users can visit our site anonymously
  • There is a link to this Privacy Policy on the footer of our Site
  • Our Privacy Policy link includes the word “Privacy” and can easily be found by clicking the link on our footer or going to this URL: https://risemediation.com/privacy-policy/. It is titled “Privacy Policy” very clearly.
  • You will be notified of any Privacy Policy changes on this Privacy Policy page (see bottom “Updated On” date)

Children’s Online Privacy Protection Act (“COPPA”)

We do not market to children under the age of 13. Please STOP and do not use, view, download from, or browse the Site or the Content if you are under 13 years old. If you are younger than 13, you are not permitted to enter any Personal Information on this Site.

If you are a parent and you believe your child under the age of 13 has provided us with Personal Information, please contact us immediately to have it removed by emailing us.

Fair Information Practices

In order to comply with Fair Information Practices, we will take the following responsive action should a data breach occur: We will notify you via email of any known breach within three (3) business days of our learning about it.

CAN-SPAM Act of 2003 (the “CAN-SPAM Act”)

The CAN-SPAM Act is a U.S. law that establishes rules for commercial email messages, gives you the right to stop certain commercial emails from being sent to you, and outlines certain penalties for commercial entities or persons who violate the law.

We collect your email address and name so we can (if and as applicable):

  • Send information, respond to inquiries, and/or handle other requests or questions (such as Consultation bookings)
  • Process requests for services and send information and updates pertaining to those services
  • Send business-related emails to you in the future should they be relevant and reasonable

In accordance with the CAN-SPAM Act, we agree to the following:

  • We will not use false or misleading subjects or email addresses
  • If an email message is an advertisement, we will identify it as such in some reasonable way
  • We will include our business mailing address and/or physical address in our emails
  • Should we use them, we will monitor third-party email marketing services for compliance 
  • We will honor opt-out/unsubscribe requests quickly
  • We will allow recipients to unsubscribe by responding to any email with the request “UNSUBSCRIBE” in the subject line

  • Know how long we’ll keep your information—we will keep your Personal Information until the earlier of either (1) you asking us to delete your information or (2) the Company decides it no longer needs the data and the cost of retaining it outweighs the value of keeping it
  • Access, rectify, or erase your Personal Information
  • Withdraw your consent to the Company’s processing of your data, which shall have no effect on the lawfulness of the processing of your Personal Information prior to your withdrawal
  • Lodge a complaint with a supervisory authority that has jurisdiction over GDPR or UK GDPR (as the case may be) issues
  • Provide only your Personal Information which is reasonably required to enter into a contract with us; the Company will not ask for your consent to provide unnecessary Personal Information on the condition of entering into a contractual relationship with us
