By using risemediation.com and/or purchasing, viewing, downloading, attending, participating in, or otherwise engaging with or signing up to receive any newsletters, emails, social media posts, promotional material, blog posts, information, courses, video tutorials, Zoom or other Q&A sessions, streaming or other video events, event invites, mediation services, checklists, documents, ebooks, forms, guides, planners, templates, workbooks, worksheets, and/or any other products or services we offer via this website or our email lists at any time, you voluntarily and implicitly agree that you have read (or had the opportunity to read and chose not to), understood, and consented to this Privacy Policy as stated. 

Overview. We collect only the data necessary to run our site in the manner in which it is designed to perform and deliver on the values and vision of our business. We do not advertise on behalf of third parties, nor share your data with third parties unless required for our business to function in its intended manner, including legal compliance, safety, and the protection of our site users, clients, potential clients, and visitors. We do not presently engage in affiliate marketing, nor have or share data with any affiliates.

Capacity: To use this site, you must be at least 18 years old and be able to consent to this Privacy Policy. If you are under the age of 18, or you do not agree with this Privacy Policy as stated herein, please STOP now and do not use this site or its content. By using the site, you agree to the Privacy Policy as written, regardless of whether or not you have read it. “Agreement”, singularly, or “Agreements”, collectively, means this Privacy Policy, our Terms & Conditions, Cookie Policy, and Disclaimer. 

“Company”, “we”, “our”, or “us” means Anne MacIver LLC DBA R.I.S.E. Mediation and risemediation.com (collectively, “R.I.S.E.”).

“Content” means any and all written, visual, video, audio, downloadable and other information contained on or accessed via the Site and/or included in or offered or provided by us via the Site, email, mobile app, link, podcast, portal, streaming or other media, social media or marketing outreach (paid or otherwise), or other communication or access medium at any time, including but not limited to (i) graphics, designs, layouts, blog posts, and email lists, (ii) all other intellectual and/or creative output, including but not limited to the names of our Services and/or Products (as defined below), whether or not registered with a state or federal trademark or copyright office, and whether or not displaying a trademark™ or copyright© symbol, (iii) any and all emails received from R.I.S.E. or Anne MacIver, and (iv) material used, purchased, viewed, consumed, and/or downloaded via any medium referenced or contemplated herein expressly including but not limited to our Services and/or Products (as defined below) as well as promotional material.

“Personal Information” or “Information” means information that can be used on its own or in conjunction with other information to identify, contact, or locate a person or to identify an individual in context. For example, Personal Information includes, among other things, your name, address, email address, telephone number, and credit card information. It also includes information related to your use of the Site such as, generally speaking, information about your geographic location and site behavior, what type of device or software you use, your IP address (with location information), and/or whether you view our website on mobile, tablet, or desktop.

“Site” means risemediation.com and any and all of its associated pages and posts, tabs, landing pages, forms, features, sub-pages, functionality, and elements.

“You” or “your” means the user, customer, or viewer of the Site.

Incorporation by Reference

The R.I.S.E. Cookie Policy is hereby linked and incorporated by reference into this Privacy Policy and thus forms a part of this Privacy Policy.

Further, this Privacy Policy is itself incorporated by reference into the Site’s Terms & Conditions and thus forms a part of those Terms & Conditions. Every visitor to this Site is subject to and deemed to agree to the Terms & Conditions, as stated and unmodified.

Who We Are

We are an Illinois family mediation resource, and we provide information, education, and a means of pursuing Illinois mediation in a family, relationship, or divorce context. Our website address is https://risemediation.com. This page explains what data we collect from you, how we use it, and why.

The Site and the Content are owned by Anne MacIver LLC DBA R.I.S.E. Mediation. We are committed to protecting your Personal Information. We will only collect or use your Personal Information in accordance with this Privacy Policy.

By viewing, using, or purchasing/downloading on or from the Site or its Content, you acknowledge that R.I.S.E., its members, its staff, and its independent contractors may access your Personal Information, within the parameters, terms, and conditions set forth in this Privacy Policy.

When do we collect Personal Information?

We collect Personal Information from you when you order, purchase, download, or sign up for any of our Services and/or Products, register as a Site user, fill out a form, book a consultation (offered via integration with Calendly.com), enter any of your Personal Information on the Site, respond to a survey or marketing communication, and/or browse or interact with the Site. If you’re just viewing the Site, you won’t be required to provide Personal Information to browse. 

What kind of Personal Information do we collect?

Personal Information you provide. When using the Site, and in filling out forms and/or user fields, purchasing products, providing comments, or contacting us, you may be asked to enter your name, email address, mailing address, payment or credit card information, or other Personal Information. We use this Information to deliver the product purchased or information requested, to improve the performance and applicability of the Site and the Content, and to provide you with the best content we can, which may include educational content, newsletters, promotions, and special offers. Personal Information otherwise collected. The Company may use data collection technology (such as Google Analytics) to collect information related to your use of the Site which, generally speaking, includes information about your geographic location and Site behavior. The data collection company(-ies) also provides us with information about what type of device or software you use, your IP address (with location information), and whether you view the Site on mobile, tablet, or desktop. We collect this information for statistical purposes only and to improve the viewer experience.

Comments, Submissions & Uploads

User uploads. As of June 2023, we do not have a comment functionality on the Site. That can change at any time within our discretion; therefore, the information on this page applies to all comments left on the Site as well as all uploads onto the Site, including forms (for example, via our Consultation booking form).

Data collected. When a visitor leaves a comment on or makes an upload to the Site, we collect the data shown/submitted in the upload fields, as well as the visitor’s IP address and browser user agent string to help spam detection.

Images. If you upload images to the Site, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the Site can download and extract any location data from images on the Site. 

Avatars. Should we ever permit user-content engagement with the Site, which may involve the use of avatars, this paragraph will apply. When making a comment, an anonymized string created from your email address (also called a hash) may be provided to an avatar service to see if you are using it, and that service’s privacy policy will apply. For users without such accounts, your avatar may be created within the Site via a local plugin. After approval of your comment, your profile avatar will be visible to the public in the context of your comment.

How do we use your Personal Information?

Email lists (if you’re outside the European Union and United Kingdom). If you purchase or sign up to receive any Service(s) and/or Product(s) from us, you may automatically be added to an email list(s) to receive free email messages from us.   • To allow us to better serve you in response to your customer service requests

If the Personal Information we have collected about you is incorrect or incomplete in any way, or you would like to update what we have, please email us. We will make the appropriate corrections when notified, as long as the corrections requested to be made are not incorrect or fraudulent in any way.

Who else receives your Personal Information?

Shared by or transmitted through us. In general, we do not sell, trade, transfer, or otherwise allow or facilitate the access of your Personal Information to outside (third) parties, whether for marketing or advertising purposes or otherwise, except as follows:

  • Law enforcement, government entity(-ies), court(s), and/or other third party(-ies) as required and/or allowed (for a compelling purpose such as legal compliance, personal or client protection, or safety) by applicable law, to comply with or facilitate an investigation, process, or inquiry
  • Third-party service providers that provide products, tools, platforms, services, or functions necessary to manage and execute this Site and/or related to the management and running of our Company or our Services and/or Products. Such service providers may receive and/or process your data as part of their service and may include, without limitation, payment processors (such as Stripe and PayPal), and email management or transmission systems (such as WP Mail SMTP or Constant Contact).
  • Automated spam detection and prevention service(s) and/or other security technology, whose functions include but are not limited to analyzing comments and/or uploads for the purpose of protecting our Site
  • Social media platforms, such as Facebook, Instagram, Twitter, Pinterest, Reddit, and LinkedIn, whose services are linked to or facilitated through our Site (for example, pinning an image to Pinterest or sharing a link to Facebook)—if you use such functionalities on our Site, you will be taken away from risemediation.com and any Information shared will be subject to the policies and security measures of those external platforms
  • Third-party marketing or advertising platforms, such as social media (e.g., Facebook and Instagram), that track and categorize your interests and Site behavior so that we may market and advertise to you. We reserve the right to share Information with those third parties, and they in turn may collect information, including your actions taken on the Site, through tracking methods such as cookies (details in our Cookie Policy). The third parties may also possess or obtain information about you from your behavior/actions of the following kind: directly with those third parties; on or from other websites, mobile apps, or companies that the third parties work with; or from your interactions with advertisements the third parties show you. The information they collect and/or the Information that we share may be used to customize or personalize the advertisements displayed to you.
  • Subsidiaries, contractors, subcontractors, assigns, affiliates, and/or successors in interest of R.I.S.E. when necessary to carry out our business functions—this may include website hosting partners and other parties who assist us in operating our Site and/or email service(s), conducting our business, and/or serving our users—so long as those parties agree to keep the Information confidential
  • Third-party tech support engaged by us to repair or improve our Site periodically and/or over a limited period of time, during which they have the same Site and Information access as any Site administrator

Disclaimer for non-personally identifiable visitor information. Non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. 

Disclaimer for Personal Information shared by you directly with or for viewing by third parties. We collect Personal Information from you for the purposes of running our business, the ultimate goal of which is to serve you, as set forth in the paragraphs above. If, however, you choose to make your Personal Information available directly to or for viewing by third parties through our Site or our Services and/or Products, R.I.S.E. is not responsible for any unauthorized use by that third party. 

How do we protect your Personal Information?

Security and malware protection. We aim to make your visit to our Site as safe as possible and thus take many precautions to protect the data that is shared with us. In addition to the measures mentioned elsewhere in the Agreements, we use a managed hosting service that provides several security layers. Backed by the Cloudflare Enterprise web access firewall, the site is secured with enterprise-grade security before any attempts are made to reach the host server. In the unlikely event such attempts were to reach the server, Imunify360—a comprehensive, next-generation malware scanner and total security installation—runs on each node, adding another layer of defense. Your Personal Information is only accessible by a limited number of persons who have special access rights to these secured systems and are required to keep the Personal Information confidential.

Enterprise-grade encryption. All sensitive credit card or payment information you supply is encrypted via Secure Socket Layer (SSL) technology. We implement a variety of security measures when a user places an order to maintain the safety of your Personal Information. All transactions are processed through a gateway provider. We will never transmit your credit card information by email.

The site is also protected by Google Trust Services for SSL, which facilitates end-to-end encryption of data.

How long we retain your data

We may retain your data until we dissolve our business or you request us to delete it, whichever comes first.

Commenters. If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

Do we use “cookies” or social media pixels?

Cookies. We, and third parties as described herein and in our Cookie Policy, use cookies and collect information from the computer, mobile phone, and/or other device(s) you use to access the Site, read our emails, or view our Content and/or advertisements. Information and detail on these cookies and our use of them is contained in the Cookie Policy, which is incorporated by reference in its entirety into this Privacy Policy (meaning, you are subject to and assumed to have read our Cookie Policy). Note: In the unlikely event of any conflict between the cookie information on this page and the information contained in our specific Cookie Policy, the information in the Cookie Policy shall supersede and be deemed to replace the conflicting information in this Privacy Policy.

Pixels. The Company may explore the use of social media pixels (Facebook pixels) to track visitors to the Site for the purpose of tailoring messaging or advertisements towards those visitors on various social media platforms (including but not limited to Facebook, Instagram, Twitter, Reddit, or LinkedIn), and we therefore reserve the right to use pixels in accordance with the terms of those social media platforms.

What rights you have over your data

If you have an account on our Site, or have left comments, you can request to receive an exported file of the data we hold about you, including any Personal Information you have provided to us. You can also request that we erase any Personal Information we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes. Please contact us to make any such request.

Third-Party Links & Embedded Content

This Site may include embedded third-party content and/or links to third-party websites (e.g., videos, images, articles, blogs, third-party products or services).

Separate policies for outside websites. Third-party websites may or may not have separate and independent privacy and/or cookie policies. We have no responsibility or liability for the content and activities of these linked sites and/or their privacy policies, cookie policies, terms and conditions, or lack thereof.

Embedded content behavior determined by source site. Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website directly. Such other websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Affiliate Disclaimer

We reserve the right to link to products or services we find helpful at any time, including via the use of affiliate links. An “affiliate link” means we will receive a small percentage or fee for referring you to any product or service you may purchase from the linked-to site. We keep this option open because these kinds of fees could help sustain our small business.

Two things to know. (1) We will never use an affiliate link to a product we don’t believe in. (2) If we do use an affiliate link, you will know because we will tell you about it right there, somewhere nearby, where you won’t be able to miss it. 

Google Ads & Analytics

Analytics. We reserve the right to use Google Analytics. 

Ads. We are not currently using Google Ads on the Site, although this may change in the future. You can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt out by visiting the Network Advertising Initiative Opt-Out page or by using the Google Analytics Opt-Out Browser add-on.

California Online Privacy Protection Act (“CalOPPA”)

CalOPPA stretches beyond California to require any person or company that operates websites collecting Personal Information from California viewers/consumers to post a conspicuous privacy policy on its website stating exactly what information is collected and identifying those individuals or companies with whom it is being shared. 

Pursuant to CalOPPA, we agree to the following:

  • Users can visit our site anonymously
  • There is a link to this Privacy Policy on the footer of our Site
  • Our Privacy Policy link includes the word “Privacy” and can easily be found by clicking the link on our footer or going to this URL: https://risemediation.com/privacy-policy/. It is titled “Privacy Policy” very clearly.
  • You will be notified of any Privacy Policy changes on this Privacy Policy page (see bottom “Updated On” date)

Children’s Online Privacy Protection Act (“COPPA”)

We do not market to children under the age of 13. Please STOP and do not use, view, purchase, download from, or browse the Site or the Content if you are under 13 years old. If you are younger than 13, you are not permitted to enter any Personal Information on this Site.

If you are a parent and you believe your child under the age of 13 has provided us with Personal Information, please contact us immediately to have it removed by emailing us.

Fair Information Practices

In order to comply with Fair Information Practices, we will take the following responsive action should a data breach occur: We will notify you via email of any known breach within three (3) business days of our learning about it.

CAN-SPAM Act of 2003 (the “CAN-SPAM Act”)

The CAN-SPAM Act is a U.S. law that establishes rules for commercial email messages, gives you the right to stop certain commercial emails from being sent to you, and outlines certain penalties for commercial entities or persons who violate the law.

We collect your email address and name so we can (if and as applicable):

  • Send information, respond to inquiries, and/or handle other requests or questions (such as Consultation bookings)
  • Process orders and send information and updates pertaining to orders of a product or service
  • Send you additional information related to your course, product, and/or service
  • Market to our mailing list or continue to send emails to you after the original transaction has occurred
  • Email you a newsletter with free information and promoting certain products and services we offer

In accordance with the CAN-SPAM Act, we agree to the following:

  • We will not use false or misleading subjects or email addresses
  • We will identify the email message as an advertisement in some reasonable way
  • We will include our business mailing address and/or physical address in our emails
  • We will monitor third-party email marketing services for compliance—we may use Constant Contact, GMail, and WP Mail SMTP to send our emails to you
  • We will honor opt-out/unsubscribe requests quickly
  • We will allow users to unsubscribe by using the appropriate link at the bottom of each email

TO UNSUBSCRIBE FROM OUR EMAIL:

If at any time you would like to unsubscribe from receiving future emails, you can follow the instructions at the bottom of any email you receive from us and we will promptly remove you from future correspondence. However, unsubscribing from one list or set of emails may not unsubscribe you from receiving all future emails from us. If you experience any problems unsubscribing, please email us and we will promptly handle your removal!

Your General Data Protection Regulation (“GDPR”) Rights

If you are located within the European Union or the United Kingdom (“UK”), you are entitled to certain rights under the GDPR and/or the UK GDPR (as applicable). You have the right to:

  • Know how long we’ll keep your information—we will keep your Personal Information until the earlier of either (1) you asking us to delete your information or (2) the Company decides it no longer needs the data and the cost of retaining it outweighs the value of keeping it
  • Access, rectify, or erase your Personal Information
  • Withdraw your consent to the Company’s processing of your data, which shall have no effect on the lawfulness of the processing of your Personal Information prior to your withdrawal
  • Lodge a complaint with a supervisory authority that has jurisdiction over GDPR or UK GDPR (as the case may be) issues
  • Provide only your Personal Information which is reasonably required to enter into a contract with us; the Company will not ask for your consent to provide unnecessary Personal Information on the condition of entering into a contractual relationship with us
